William Cantrell is an attorney practicing exclusively in employee benefits and employment law.  Will's practice broadly includes counseling clients on compliance with matters relating to retirement plans, health and welfare plans, cafeteria plans, and fringe benefits, as well as litigation avoidance strategies with respect to benefit claims and employment law matters.   Will also provides guidance on HIPAA, COBRA, FMLA, and the Health Care Reform Act.

Will graduated magna cum laude from Florida State University College of Law. He received a B.A. from Mercer University, and an M.A. from Florida State University. Prior to entering private practice, Will served as a law clerk to a federal judge in Macon, Georgia.

DESCRIPTION OF PRESENTATION
Employers sponsoring retirement plans or health plans often suffer significant financial liability for either their or their third-party administrator’s improper administration of a myriad of arcane legal documents affecting such plans – such as qualified domestic relations orders, qualified medical child support orders and powers of attorney.  This presentation will provide an overview of how these documents affect employee benefit plans, as well as provide best practices for avoiding compliance failures and strategies for reducing administrative costs associated with compliance.

Specific topics will include:

How QDROs, QMCSOs, and similar legal documents affect employee benefit plans
ERISA’s administrative and review requirements for QDROs and QMCSOs
Specific legal dangers associated with powers of attorney and similar documents
Best practices for avoiding compliance failures
Auditing third-party administrators for compliance
Strategies for reducing administrative costs
Penalties for noncompliance

SPECIFIC LEARNING OBJECTIVES
Attendees will learn the basic legal obligations for reviewing and administering legal documents affecting employee benefit plans, including a summary of the type of legal documents commonly submitted by employees that affect such plans.

Attendees will learn best practices for avoiding compliance failures and simple tips on how to reduce administrative costs associated with compliance.

Attendees will learn how recent legal developments, such as the Health Care Reform Act and new Department of Labor rules, affect the review and administration of QDROs, QMCSOs, and similar legal documents.
